AREAS OF EXPERTISE

Property Litigation

Paul is a property litigation specialist with 19 years’ experience. He is an expert in commercial property dispute issues including security of tenure claims, drafting and advising on property notices, property sale and purchase contracts, rights of pre-emption, forfeiture and relief claims, party walls disputes, commercial rent arrears recovery (CRAR) and the full spectrum of real estate insolvency work (including IVAs, bankruptcy, company administrations, liquidations, CVAs, Bona Vacantia, vesting orders, disclaimer).

Prior to joining Davitt Jones Bould, Paul practised at Tier 1 Legal 500 firms, where he advised blue chip corporate investors, Homes England, Local Government clients as well as clients in the investor, retail and leisure sectors.

WORK HIGHLIGHTS INCLUDE

  • Advised numerous blue-chip corporate investors, alongside Homes England and the Regulator of Social Housing on the implementation of housing law and the insolvency of 75 adult care homes.

  • Advised Westminster Council, this included a review of their tenancy portfolio of secure tenants by way of data review leading to human errors being eliminated.

  • Advised Hounslow Borough Council on their regeneration scheme which will deliver 2400 new high-quality homes over a 10 to 15-year development programme. This included advice provided on their vacant possession and re-housing strategies.

  • Advised on major schemes with tenant portfolios of over 1,250 tenants which were systemised to keep costs low and bring about compliance with statutory requirements in serving pre-emption notices.

  • Assisted in the management of the entire NatWest and RBS portfolio review, over 500 properties, where each property had residential occupiers and produced bespoke reports to allow for vacant sales to take place once the banks sought to vacate.

  • Advised on high-value real estate transactions generally and in particular with mixed use residential structuring issues / overlay (s5 LTA 87 issues and procedures).

  • Carried out transactional notices and court proceedings relating to a residential conveyance which led to specific performance claims. This resulted in successfully obtaining relief in a £136 million contract for sale claim.
