Planning 

Ifath is a planning specialist, who has practised in both the public and private sectors advising clients on governance, planning, transport, infrastructure and regeneration projects, with particular experience in major development projects and national infrastructure projects.

WORK HIGHLIGHTS INCLUDE ​

  • Advised Buckinghamshire Council on the High Speed 2 Project,this included:

    • Advising on the statutory process, the preparation of evidence for both Select Committees stages of the hybrid bill process;

    • Being the only solicitor out of the 17 local authorities on route of Phase One route, London to Birmingham, who sat on the Planning Forum, Environmental and Highways Sub Groups to partake in the planning and production of the suite of documents comprising the Environment Minimum Requirements which included the Planning Memorandum, Planning Forum Notes, Information Papers, Code of Construction Practice, Establishment of Independent Construction Commissioner and Independent Residents Commissioner;

    • Advising the Colne Valley Panel and clients on the design of the Colne Valley Viaduct which is a world class design which stretches over 3.4km through a series of lakes and waterways between West London, the M25 motorwayand Colne Valley;

    • Project managed team of planners, heritage, landscape, engineers, noise specialists in dealing with applications for Schedule 17 consents for approval of design and mitigation and highways consents.

    • As Project Manager devised system for recording the progress of the project as it was rolled out, attendance at all pre-application meetings, organized and presented at community engagement workshops, engagement with other statutory bodies like the Environment Agency,Natural England, and Historical England;

    • Led on presentation and engagement on the project with the Developer, Main Works Contractors, Communities and all other relevant stakeholders on the project as it was progressed from 2017 to 2021;

    • Continuing to advise on all highways and applications under the HS2 Act, drafting of reports, media communications, planning and other related applications; Presentations to Councillors, Cabinet of Council on progress of report, community issues and concerns, finding solutions with all relevant stakeholders;

    • Managing all planning and highways appeals by HS2 against Council decisions; Managed budget of local authority client on expenditure, payment of consultants and employees and also managed £6m budgets awarded to the Colne Valley Regional Park Panel and Chilterns Area of Outstanding Natural Beauty for further and better mitigation projects; and

    • Reported to Project Board every 6 weeks on all aspects of the project.

  • Advising international magazine owner on their site in London for redevelopment purposes, putting together a team of architects, planning consultant, Project Manager and others to draw up plans and present to the Board.

​

  • Advising a Property Management company on their various sites including a site in West London, which had been compulsorily purchased, and the Council was seeking recovery of rent from our clients from the date of Vesting Declaration. This was challenged on the basis of failure to serve the notices correctly and the Council conceded.

  • Advising on S106 agreements for number of developer clients involving, mixed use development of residential, commercial floor space, public and private amenity space, with obligations for affordable housing viability review, financial contributions, travel plan, Employment skills and training obligations, paths and estate roads and Management company for the Estate Roads.

  • Advising international clients on their mixed use major developments in London comprising commercial, residential, affordable housing, on S106 agreements, deeds of variation, highways agreements, licenses and advising generally on issues that arose as projects progressed.
