LGR: ENFORCEABILITY OF RESTRICTIVE COVENANTS: TIPS AND TRAPS

Session 3 -Local government reorganisation is set to reshape councils across England, with mergers, restructuring and large-scale asset transfers taking place on a scale not seen for decades.

When organisations of any kind look at mergers, property is a big part of every deal, and that is even more true in the public sector, where vast portfolios sit under local authority ownership.

A knowledge of restrictive covenants in freehold land is essential for the acquisition and disposal of land. The course aims to look at some of the issues and suggest tips as to their effectiveness.

• Discharge of restrictive covenants in the light of Great Jackson Street Estate v Manchester City Council (2025) and Blackhorse v Southwark Borough Council (2024);

• Effect of planning permission on the validity of restrictive covenants;

• Local authority discharge of covenants under s.203 Housing and Planning Act 2016;

• Right to Buy covenants;

• Passing of the benefits of covenants;

• Passing of the burden of covenants;

• Interpretation of common covenants; and

• Local authority enforceability of positive covenants and S.33 Local Government (Miscellaneous Provisions) Act 1982.
