Biodiversity Net Gain alert – Planning appeal dismissed on basis BNG not demonstrated.
Stephanie Hall, Planning Partner, commented "An Inspector has recently dismissed an appeal for the construction of a care home in Wychavon on the basis that it was not demonstrated that the development would provide the necessary BNG as required in the local plan, neighbourhood plan and the NPPF. The original application was made well in advance of the introduction of mandatory BNG therefore developers and local planning authorities must be alive to local and national BNG requirements for all planning applications, not just those submitted after January 2024."
