Government Lifts Nutrient Neutrality Advice in Harbour Area

Planning Update August 2024


Natural England has lifted the nutrient neutrality advice for phosphorus in the Poole Harbour catchment area, a Special Protection Area and RAMSAR site, which could see thousands of new homes receive planning permission in years to come. This is because planned preventative measures to wastewater treatment works are “so significant that they will reduce phosphorus to levels consistent with conservation objectives”.

Nutrient neutrality restrictions have stymied housing growth in certain parts of the country. Housebuilders have previously had to purchase credits in offsite habitat banks in order to offset the impact on protected watercourses (in a similar way to the new BNG regime). However, this announcement demonstrates the importance of preventative measures in addition to mitigation. Whilst good news for local authorities and housebuilders seeking to boost housing supply, it does raise the question of what will happen to the land taken out of agricultural use and set aside for phosphorous credits.
