What is the impact of the findings in: R (Suffolk Energy Action Solutions SPV Ltd) v Secretary of State for Energy Security and Net-Zero?
It is common in large scale regeneration and infrastructure schemes for the scheme promoter to reach an agreement with a landowner to acquire the land necessary for the project, subject to the landowner agreeing not to object to the proposals through the planning process. The decision gives comfort to scheme promoters that such agreements are not unlawful. This has been the case for some time and is a useful reinforcement by the Court of Appeal of the existing legal position.
